Interjurisdictional Support Orders Act (ISO)

The Interjurisdictional Support Orders Act (ISO Act) provides the process for obtaining, varying and registering support orders for enforcement if one parent lives in one province and the other parent lives in a reciprocating jurisdiction (most other provinces and states). Reciprocating jurisdictions are listed in the ISO Act and include all provinces and the United States of America. In Ontario the ISO Act replaces the Reciprocal Enforcement of Support Orders (RESO) Act.

The ISO Act offers the option of a written application with evidence that can then be forwarded to the respondent’s jurisdiction to be processed. The forms are a way of organizing the information the court needs. The court in the respondent’s jurisdiction will then request evidence, in written format from the respondent. If additional evidence is required from either parent, the court has the flexibility to obtain it in the most expeditious and fairest way possible. This new procedure eliminates the need for court hearings in both jurisdictions.

In Ontario the ISO Act came into effect on March 31, 2003 and it is administered by the Interjurisdictional Support Orders Unit of the MC&SS’s Family Responsibility Office. Please see the Guide "Introduction and General Information"

Please note that the ISO Act does not apply to support orders made under the federal Divorce Act or where both parties live in the same province.
